Welcome to Favist. These Terms of Service ("Terms") are a binding agreement between you and the operator of Favist ("Favist", "we", "us"). By creating an account, accessing, or using favist.ai or any related apps and services (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old (or the age of majority where you live) to use the Service. You are responsible for your account, for keeping your credentials secure, and for all activity under your account. Provide accurate information and keep it current. We may refuse, suspend, or terminate accounts at our discretion, including for any violation of these Terms.
Favist lets you save, organize, and share favorites — music, movies, podcasts, books, places, wishlists, people, ideas and more — into shareable lists, with optional AI assistance. Catalog data, artwork, links, and playback are provided via third parties (e.g. Apple/iTunes, TMDB, YouTube, Spotify). The Service is provided on an "as is" and "as available" basis and may change at any time.
You retain ownership of the content you add (lists, notes, photos, text — "User Content"). You grant Favist a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content solely to operate and improve the Service and to show content you choose to make public or share. You represent that you have the rights to your User Content and that it does not violate these Terms or any law or third-party right. You are solely responsible for your User Content.
You agree not to, and not to allow anyone to:
We may remove content and suspend or terminate accounts for any violation, and may report unlawful activity to authorities.
Paid plans, promotions (including time-limited launch pricing), affiliate commissions, and ambassador retainers are processed through third-party providers such as Stripe and PayPal. By transacting through the Service you also agree to those providers' terms and Acceptable Use Policies, and you agree not to use the Service for any business, good, or transaction those policies prohibit (including, without limitation, illegal goods/services, regulated products, adult content, gambling, money transmission, or high-risk activities).
Wishlists and gifting are for personal, non-commercial use only. You may not use Wishlist, gifting, claims, links, or any Favist feature to solicit, collect, route, launder, or receive payments or compensation outside the intended personal-gift purpose — including as a payment, escrow, donation, fundraising, money-transmission, tipping, or quid-pro-quo mechanism, or to receive compensation for goods or services. Affiliate and ambassador earnings are paid only under their separate program terms, require valid tax documentation (W-9/W-8), and may be withheld or reversed for fraud, fake or incentivized signups, or policy violations.
Fees are non-refundable except where required by law or expressly stated. We may change pricing prospectively.
The Service includes an AI assistant. AI output may be inaccurate or incomplete; verify before relying on it. You are responsible for actions you take through the assistant, and the assistant operates only with your permissions.
The Service integrates and links to third-party platforms (e.g. Apple, Google, Spotify, YouTube, Amazon, Stripe, PayPal). We do not control and are not responsible for third-party content, services, or terms. Your use of them is governed by their agreements.
If you sign in with Google or grant Favist access to Google data, your use is subject to Google's terms, and Favist's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. We request only the scopes needed (such as basic profile and email, and — where you enable a feature that requires it — read access to specific Google Drive files you choose). We do not use Google user data for advertising and do not sell it. You can review or revoke Favist's access at any time at your Google Account's security settings. See our Privacy Policy for details.
The Service, including its software, design, and trademarks, is owned by Favist and protected by law. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. All rights not expressly granted are reserved.
Favist is a discovery and curation layer: we do not host or stream copyrighted media — playback and opens happen through licensed third-party services and their official players. We respect rights holders and act promptly on valid copyright notices. See Copyright & Creators for how Favist works with the ecosystem, and contact copyright@favist.ai for any rights concerns.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that catalog data or AI output is accurate.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAVIST AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.
You agree to indemnify and hold Favist harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.
You may stop using the Service and delete your account at any time. We may suspend or terminate access at any time, with or without notice, for any reason, including suspected violations. Sections that by their nature should survive (e.g. content license to the extent of public/shared content, disclaimers, liability limits, indemnification) survive termination.
We may update these Terms. Material changes will be posted here with a new effective date; continued use after changes means you accept them.
These Terms are governed by the laws of the jurisdiction in which Favist's operating entity is established, without regard to conflict-of-laws rules, and disputes are subject to the exclusive jurisdiction of its courts (specific governing law and venue to be set by the operator). Nothing limits rights you cannot waive under applicable consumer law.
